Vheiwa is being charged with one of the most serious crimes, rape as defined in Section 65(1) of the Criminal Law [Codification and Reform] Act Chapter 9:23.
Prosecuting Thimoty Katsande representing the state told the court that on December 3, 2020 the complainant proceeded to the accused person’s house to get braiding wool from the accused person’s sister who she asked for and was told had gone to the field but she could just take the braiding wool from the dinning.
Whilist the complainant was still in the dinning room she saw the accused person behind her who then pushed her down to the ground, lifted up her skirt, removed her panties and forcefully had non consensual sexual intercourse with her once.
The matter came to light with rumours that the complainant was pregnant and her mother (identity withheld) took her to the clinic where tests proved that she was indeed pregnant and having been persuaded by the nurses, she then disclosed that she had been raped by Vheiwa which led to the accused’s arrest.
Presiding Magistrate Elizabeth Hanzi, heard the case and denied him bail while trial date was set to April 14, 2021.
