A 22 year old Rusape man was this Wednesday sentenced to 60 months in prison for unlawful entry, rape and having sexual intercourse with a minor.
Presided over by Rusape Magistrate, Obidience Matare, Dennis Mashumba Chiuya pleaded guilty to all three charges and was served with a 60 month jail term.
6 months where suspended on condition of good behavior and does not commit the similar offense in the next 5 years.
It was the state’s case against Mashumba.
The Court heard that on August 3 2021 the accused person gained entry into a 73 year old, Loice Matewa’s hut without her authority as defined in section 131 of the criminal law codification and reform act chapter 09:23.
On the same night at the same residence of Matewa at Matewa village in Nyazura, the accused attempted to rape the complainant only to be saved by her neighbor, Obvious Gwaze who removed Mashumba on top of Loice Matewa as he was still mounting.
A report was made and the accused was arrested and charged with attempted rape as defined in section189 as read with section 65 of the criminal law codification and reform act chapter 09:23.
On Count 3, Mashumba admitted to the charge of having sexual intercourse with a minor as defined in section 70(i) (a) of the criminal law codification and reform act chapter 09:23.
Reported in August 8 2021, Mashumba is said to have entered into a relationship with a juvenile aged 12 and 13 (Names withheld) and when the girl visited Mashumba at his homestead, he had sexual intercourse with her thus committing a crime.
